John Allen Muhammad's lawyers urged a judge Friday to spare the convicted sniper mastermind from the death penalty, saying it would be wrong to leave his kids fatherless.

The defense said it would be "simply cruel to inflict additional pain on additional innocent children" by ordering his execution.

Muhammad, a father of three, is scheduled to be sentenced Tuesday.
