Ferndale scraps zoning that limits height of church steeples

FERNDALE - The City Council voted unanimously on Monday, Jan. 7, to strike a line from residential zoning code that limits the height of church steeples.

There are currently no plans in Ferndale for a church exceeding 35 feet in height. Council wanted to eliminate a restriction that conflicts with federal law.

The height limit remained in city code after the city reversed a decision in 2005 to not allow the Church of Jesus Christ of Latter-day Saints to erect a spire 71 feet high, Community Development Director Jori Burnett said.

At the time, city officials decided to allow the construction out of concern that such a restriction would violate the First Amendment.

The city struck the height restriction Monday, after learning it specifically violates a 2000 federal law that prohibits local governments from unreasonably limiting religious structures.

    FERNDALE - Jon Mutchler, pastor and musician, would like to continue wearing another hat in the city - that of city council member.

    Mutchler, 53, announced Monday, April 29, he will seek a second term on the council. He defeated incumbent Ken Downey by five votes in a recount in 2009.

    Mutchler is a fiscal conservative who voted with the minority against a 3 percent property tax hike for 2013.

    FERNDALE - Lummi Nation was on the verge of jump-starting major retail development along Slater Road but canceled the possible sale of 25 acres to a major retailer because the tribe and the city of Ferndale failed to reach agreement on how to divide sales tax revenue.

    The Lummis haven't divulged the potential purchaser or plans for the property at the southwest corner of Slater and Rural Avenue. But drafts of the agreement discuss significant sales tax receipts and traffic impact fees, which suggest a big-box store.

    The store would have been the first of many envisioned between Rural Avenue and Interstate 5, and along the freeway to the south.

  • Property owner agrees not to be paid in Ferndale condemnation case

    FERNDALE - The city doesn't need to pay the owners of an 18-acre property on the corner of Church Road and Main Street to take part of the land for road projects. For their part, the owners of the undeveloped lot won't be required to pay an improvement fee, if the city chooses to assess it.

    The city sought to purchase a 27-foot strip along the lot's western boundary, on Church Road, and a strip 341/2 feet wide on the south edge, along Main Street. Both sections of property were needed to widen and improve both Main and Church.

    The signed agreement, which resolves the city's condemnation lawsuit against Clyde Watkins and Katherine Harrison, was filed in Whatcom County Superior Court on Wednesday, March 6. The City Council approved the deal on Feb. 19.

  • Police asked to watch for illegal turns at Church Road in Ferndale

    FERNDALE - City officials have requested increased police patrols on Main Street to deter drivers from crossing the solid-white fog line before turning onto Church Road.

    Drivers have been crossing the fog line illegally to use the shoulder of the road as a right-turn lane. This can lead to a collision with vehicles staying in the legal lane before turning, city officials said.

    When weather permits this winter, crews will create a turn lane to eliminate confusion, city project manager Katy Radder said. In the spring, crews will complete the Main Street widening project from Douglas to Church Road by laying down the final layer of asphalt and adding the final striping.

  • Douglas Road in Ferndale to be closed Friday

    FERNDALE - Douglas Road between Ferndale Mobile Village and South Church Road will be closed 7:30 a.m. to 5 p.m. Friday, Feb. 8.

    Traffic will be detoured onto Imhoff Road and South Church. Local access will be allowed.
