A Pierce County man convicted of child pornography charges last year pleaded not guilty Thursday to new allegations he had sex with his 12-year-old foster daughter and continued communicating with her after she was removed from his home.
Brandon Philpot, 37, is charged with two counts of second-degree child rape. His bail was set at $40,000 Thursday. The court summons for his arraignment was sent to a Spanaway address.
According to charging papers:
The girl, now 15, had been placed in Philpot’s home as a dependent. She told police she was 12 when Philpot had sex with her multiple times.
She later was adopted and her adoptive father told Ellensburg police in February 2013 that she had been removed from Philpot’s home when he was investigated for child pornography.
The adoptive father reported to officers that a family friend told him the girl talked about a relationship with a 37-year-old secret boyfriend. The father said he then read the girl’s journal and found references to a 2 1/2-year relationship with someone named Brandon.
She also had written about checking emails from Brandon at school.
In April, a student contacted police and gave them notes the girl had written.
One read: “I was taken advantage of when I was 12. He made me believe that we were in a normal relationship. But when I finally thought thoroughly about it I noticed something was wrong. He used me for sex . . . that’s it.” Court records don’t say whether the note included a name of the suspect.
In the earlier case, Philpot pleaded guilty in August to two counts of viewing child pornography and was sentenced to one month of incarceration (served via electronic home monitoring) and 12 months of community custody.
