Fireworks: Small claims court for violators

Re: “Fireworks rules still don’t go far enough,” (TNT editorial, 7/25).

I am advocating for civil enforcement of Tacoma’s fireworks prohibition through the use of small claims court.

There aren’t enough police officers available to catch the scofflaws, and enforcement against these nuisances necessarily must be a lower priority than crimes against people.

Local governments should support civil enforcement through small claims court (for claims up to $5,000) as invasion of right of private occupancy. This right to be free from outside nuisances has been recognized in multiple jurisdictions.

The ordinances prohibiting fireworks should be amended to call out civil enforcement as an option for those deprived of enjoyment of their residence by the nuisance of fireworks.
