Man shot by Puyallup cop faces $2 million bail in attempted murder of his sister
A 36-year-old man has been charged with second-degree attempted murder after allegedly trying to drown his sister in a pool, breaking a window at his family’s house and charging at a police officer with a metal baton.
Brandon Michael Holland made an appearance in Pierce County Superior Court on Monday — 17 days after the incident on June 5, which ended with a police officer shooting Holland. Holland’s injuries were life-threatening, The News Tribune previously reported, and he was sent to the hospital.
Now recovered, he is facing the charges of second-degree murder, as well as first-degree burglary, two counts of second-degree assault and two counts of violating a court order.
The state’s Office of Independent Investigations is also investigating shooting, with the officer having previously been identified as 29-year-old Zion Gregory from the Puyallup Police Department. Shelbie Boyd, spokesperson for the Tacoma Police Department, told The News Tribune that TPD is investigating the case up until Gregory shot Holland as part of the Pierce County Force Investigation Team.
At the arraignment, Court Commissioner Barbara McInvaille set bail at $2 million.
If released, Holland would not be allowed to own weapons, consume alcohol or drugs or travel anywhere outside of Pierce, King, Thurston or Kitsap counties. He would also be electronically monitored, required to show up to regular check-ins, and forbidden from having any contact with his sister, mother or father.
Court documents say Holland previously had no-contact orders that forbade him from interacting with both his father and his sister, and was living at the family’s house in violation of the orders. He previously had convictions for third-degree assault domestic violence, third-degree assault law enforcement and a pending charge for fourth-degree assault domestic violence.
Holland’s sister told police that he was drunk during the June 5 incident, and had stopped taking medications for a mental health condition a month ago, documents say.
What happened on June 5?
According to court documents, Holland’s sister told police he had been kicked out of his friend’s house earlier that day, and went to his family’s house to live there.
“There were no contact orders in place and he was not allowed to be there,” Jennifer Quilio, a detective with the Tacoma Police Department, wrote in court documents. “[His sister] stated that her parents let Brandon stay anyway and her father has denied the physical assaults and refused to cooperate with police to avoid implicating his son.”
At about 7 p.m., he was lying in their mother’s bed in the living room, which their mother uses for medical reasons, when Holland allegedly got upset at the noise his sister was making while she was vacuuming, and his mother and sister asked him to move off of their mother’s bed, Holland’s sister said.
“Brandon became angry and aggressive and a heated confrontation took place,” the documents say.
Holland’s sister said she was going to call 911 and went outside near the family’s swimming pool, documents say. Holland allegedly told his mother: “That’s OK, I’ll kill her,” and then charged at his sister.
The two siblings fell into the pool, documents say, where Holland tried to drown her.
“[His sister] said that at least one time she was under water for 10-20 seconds and ran out of air in her lungs before she could use her legs to push off the pool bottom and get her head above water to breathe,” documents say.
Their father ran out and pushed Holland off of his sister, documents say, and his sister retrieved their father’s phone and ran to a neighbor’s.
His sister later told police that Holland was chasing after her, shouting, “Get back here, I’m going to kill you.”
One of the neighbors stopped Holland by putting his hands on Holland’s chest, documents say, and the sister ran into the neighbors’ garage, which they shut. His sister called 911, telling them her brother had just tried to kill her.
Holland then ran back to the house, documents say, and Holland’s father called 911 in a separate phone call, saying Holland was trying to break the door down.
While his father was holding the door closed, Holland allegedly grabbed a metal baton — which his family later told police he keeps in his car — and smashed the oval window at the top of the door.
Officer-involved shooting
Gregory was the first officer at the scene, according to documents, and was waiting for backup when Holland walked off the porch and towards Gregory with the baton.
Holland was yelling expletives, documents say, and Gregory ordered Holland to put the weapon down, but Holland continued to advance.
“The heated exchange continued as Brandon shouted at Officer Gregory to shoot him and Officer Gregory shouted back to stop, drop the weapon, and get on the ground or he would be shot,” documents say.
Holland then raised the baton over his head and ran at Gregory, documents say, and Gregory shot his gun three times and hit Holland twice.
“Brandon Holland is currently in critical but stable condition at [a local hospital] and is expected to survive his injuries,” Quilio wrote on June 16.
The News Tribune reached out to OII for an update on the investigation into the officer-involved shooting, but did not receive an immediate response. The office assumed the role of investigating police uses of deadly force in May.
